Terms of Service

These Terms of Service (Terms) govern your access to and use of the OrgSnapshot.ai website, the free organisational readiness snapshot, the paid deliverables and related services (together, the Service). The Service is operated by Always Optimise Pty Ltd (ABN 80 095 853 991), trading as OrgSnapshot, of Sydney, New South Wales, Australia (we, us, our). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1.The Service — and what it isn’t

• What we provide. The Service analyses organisational information you provide (a team structure, role list or org chart) and returns a readiness assessment, a modelled capacity-opportunity range, ranked workflow recommendations, implementation guides, program timelines and, on paid tiers, AI-assisted implementation support.
• Estimates, not guarantees. All figures — including any capacity, time-saving or dollar-value ranges — are modelled estimates and illustrative planning inputs. They are not a promise, projection or guarantee of any financial result, and actual results vary with your circumstances, execution and third-party tools.
• Not professional advice. The Service does not provide legal, employment, industrial-relations, financial, accounting, tax or other professional advice, and must not be relied on as a substitute for advice from a qualified professional — particularly for any content concerning role redesign, workforce change or headcount.
• Compliance content is guidance, not certification. Where the Service identifies compliance considerations (award, responsible-gambling, self-exclusion, WHS or privacy matters), those are planning prompts, not a compliance audit or certification. You remain solely responsible for your own regulatory compliance.
• You are the decision-maker. Every recommendation is advisory. You decide whether and how to implement anything the Service suggests.

2.Eligibility and your account

You must be at least 18 and authorised to act for the organisation whose information you submit. The Service is for business use, not for consumers acquiring it for personal, domestic or household use.

You are responsible for information you submit and for your account credentials. Do not submit personal information about members, customers or staff (names, contact details, salaries) into free-text or AI-assisted fields unless authorised; where practical, de-identify data first.

3.Fees, tiers and the recurring layer

Prices are in Australian dollars and, unless stated, exclusive of GST, which is added where applicable.

Recurring plans. Care and Care+ are billed monthly in advance and continue until cancelled. You may cancel at any time with effect from the end of the current billing month. We will give reasonable notice of any price change.

4.30-day money-back guarantee

To claim, email us within 30 days from the address used to buy; approved refunds are processed to the original payment method, ordinarily within 10 business days. Assisted builds (priced per workflow, from $1,900) are delivered services; refunds for those are handled case-by-case having regard to work already delivered, separate from and in addition to your rights under clause 9.

5.Acceptable use

You must not, and must not permit anyone to: use the Service unlawfully or submit content you aren’t entitled to; submit unlawful, misleading, infringing or harmful content, or personal information in breach of clause 2; reverse-engineer, scrape, resell, sublicense or white-label the Service or its outputs except as we permit in writing; interfere with the Service’s security or use it to build a competing product; or use the Service to make a decision with legal or similarly significant effect on an individual without meaningful human review.

6.Intellectual property and your data

• Our IP. We own the Service, engine, benchmarks, guides and related IP. Nothing here transfers that to you.
• Your inputs. You retain ownership of the organisational information you submit (Your Data) and grant us a licence to use it to provide, secure and improve the Service. Personal information is handled per our Privacy Policy.
• Your deliverables. On payment you may use the deliverables we provide within your own organisation; you may not redistribute or resell them.
• De-identified insights. We may create and use aggregated, de-identified benchmark data derived from use of the Service. It doesn’t identify you or any individual and remains our property.

7.Third-party tools

The Service recommends and may integrate with third-party tools and processors. We are not responsible for those third parties, their availability, pricing or terms. Your use of a third-party tool is governed by that provider’s terms, and any fees for those tools are additional and payable by you.

8.Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service and all outputs are provided “as is” and “as available”, and we exclude all implied terms except those that cannot lawfully be excluded. Subject to clause 9, we are not liable for indirect, incidental, special or consequential loss, or loss of profit, revenue, goodwill, data or anticipated savings; and our total aggregate liability is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the liability.

10.Suspension, termination and changes

Either party may stop using or providing the Service at any time. We may suspend or terminate access for breach or where required by law. Clauses that by nature should survive (including 6, 8, 9 and 11) survive. We may update these Terms; the current version, with its effective date, is always on the Service, and material changes are notified by a reasonable method. Continued use after changes take effect is acceptance.

11.Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and will attempt in good faith to resolve any dispute by discussion before commencing proceedings.
